Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you ("you", "user") and NopeSub ("we", "us", "our"). By creating an account, downloading the NopeSub iOS app, or using the website at nopesub.com, you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

NopeSub is a consumer tool that helps you find and cancel recurring subscriptions. The Service includes:

• Connecting your bank account via Plaid to detect recurring subscription charges.
• Listing detected subscriptions in-app for your review.
• Executing cancellations on your behalf, with your explicit consent per cancellation, via web automation, pre-filled forms, or AI-assisted phone calls.
• Reporting cancellation outcomes back to you.

2. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You must own the bank account you connect, or be authorized to act on the account holder's behalf.
• You must own the subscriptions you ask us to cancel, or be authorized to cancel them.
• You agree not to use NopeSub to cancel subscriptions you do not own.

3. Your account

You're responsible for keeping your password secure. If you suspect unauthorized access, email [email protected] immediately. We're not liable for losses caused by you sharing your credentials.

4. Pricing and billing

4.1 One-shot cancellations ($9 USD)

You can pay $9 per individual cancellation, billed via Stripe (web) or Apple In-App Purchase (iOS). One-shot purchases are non-refundable once we have started executing the cancellation, except as described in Section 6.

4.2 Subscriptions

Monthly subscription tiers (when offered) are billed in advance via Apple IAP (iOS) or Stripe (web). They renew automatically until you cancel. You can cancel anytime in:

• iOS: Settings → Apple ID → Subscriptions → NopeSub → Cancel.
• Web: in-app Settings → Billing → Cancel subscription.

Cancellation takes effect at the end of the current billing period; we don't pro-rate partial months.

4.3 Price changes

We may change prices for future billing periods. We'll notify you at least 30 days in advance. Continued use after the change date counts as acceptance.

5. Cancellation service — what we promise and what we don't

• We attempt every cancellation in good faith using the best available path (web automation, form, or phone call).
• We notify you of outcome within 7 days.
• We don't guarantee success. Some providers require unique customer info, in-person identity verification, or refuse cancellation entirely. When that happens, you get a refund of the $9 cancellation fee (see Section 6).
• We don't refund the subscription itself (that's between you and the provider).
• We're not responsible for charges incurred between when you ask us to cancel and when the provider processes the cancellation.

6. Refunds

6.1 One-shot cancellation refunds

If we fail to cancel a subscription you paid us to cancel, you get a full refund of the $9 fee. Request within 30 days by emailing [email protected] with the cancellation reference number.

6.2 Subscription refunds

Subscription fees are generally non-refundable, but we'll consider refund requests on a case-by-case basis. Apple-billed subscriptions: refund requests go through Apple at reportaproblem.apple.com.

6.3 Statutory refund rights

EEA / UK users have a 14-day right of withdrawal under the Consumer Rights Directive. By starting to use NopeSub immediately after purchase, you waive this right for any cancellation we have already attempted, as permitted under the Directive.

7. Acceptable use

You agree not to:

• Use NopeSub to cancel subscriptions you don't own.
• Connect a bank account you don't own or aren't authorized to use.
• Reverse-engineer, scrape, or attempt to extract source code from the Service.
• Use the Service to harass providers (e.g. ask us to make repeated calls for harassment purposes).
• Use the Service for any unlawful purpose.

We may suspend or terminate accounts that violate this section, without refund.

8. Phone calls (Path C)

When we cancel a subscription via phone call, an AI voice assistant places the call on your behalf via Twilio and OpenAI. By approving a Path C cancellation you confirm:

• You consent to the AI assistant identifying itself as acting on your behalf.
• You consent to call recording in jurisdictions where one-party consent is sufficient. In two-party-consent jurisdictions (CA, FL, MA, MD, NV, NH, PA, WA, IL, CT, MT), we will not record without your explicit per-call approval.
• You understand the AI may need to read information you provided (name, account number, last 4 of card) to the provider.
• You authorize NopeSub to cancel the specific subscription you approved, and nothing else.

9. Third-party services

NopeSub depends on third-party services (Plaid, Stripe, Apple, RevenueCat, Twilio, OpenAI, Cloudflare). We're not responsible for their availability, accuracy, or errors. Their terms apply when you use them through NopeSub.

10. Intellectual property

NopeSub, the app, the website, the brand, and all related content are owned by Ole Christian Nygjelten. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You retain ownership of any content you submit (account info, cancellation requests). You grant us a worldwide, royalty-free license to use it solely for delivering the Service.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that the Service will be uninterrupted, error-free, or that cancellations will always succeed.

12. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 12 months before the claim, or $100, whichever is greater.

We are not liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits liability that can't be limited under applicable law (e.g. gross negligence, willful misconduct, statutory consumer rights).

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from (a) your use of the Service in violation of these Terms, (b) your violation of any law, (c) your violation of any third party's rights.

14. Termination

You can delete your account anytime via in-app Settings → Account → Delete account.

We can suspend or terminate your account if you violate these Terms, with reasonable notice when possible.

On termination: your right to use the Service ends, your data is retained per the retention schedule in our Privacy Policy.

15. Governing law and disputes

These Terms are governed by the laws of Norway, without regard to conflict-of-laws principles.

Disputes will be resolved in the courts of Norway, except that EEA / UK / California consumers retain the right to bring claims in their home jurisdiction under applicable consumer protection law.

Before filing any formal dispute, you agree to first email [email protected] with the dispute description and give us 30 days to resolve it informally.

16. Changes to these Terms

We may update these Terms. Material changes will be announced by email and in-app notice at least 30 days before they take effect. Continued use after the effective date counts as acceptance.
